This Terms of Service Agreement (this "Agreement") constitutes a binding legal contract between the customer ("Customer") and Vamparossa. By using www.vamparossa.com ("Site"), ordering any product or service directly from Vamparossa or through this Site, or engaging with Vamparossa media, including social media, marketing materials, and opt-in emails, Customer signifies Customer's acceptance of this Agreement.
Vamparossa reserves the right to modify this Agreement at any time without prior notification. By using this Site or any service from Vamparossa, Customer agrees to and must abide by changes to these terms. Customer is responsible for reviewing this page periodically.
Everything Customer sees or reads on this Site (except User-Generated Content) is protected by copyright or other intellectual property rights owned by Vamparossa. Customer may download material for non-commercial, personal use only, provided all copyright and proprietary notices are retained.
Customer may not copy, reproduce, scrape, distribute, modify, transmit, reuse, repost, or use Site content, including images and copy, for public or commercial purposes without written permission from Vamparossa.
Customers may not use this Site for illegal or unauthorized purposes. Harassment, abusive language, libel, obscenities, and other inappropriate behavior are violations of this Agreement.
By using this Site, Customer agrees submissions do not violate any third-party rights, including copyright, trademark, privacy, or other personal rights. Customer is solely responsible for submissions and comments made on this Site.
Vamparossa is not required to monitor user-generated submissions but reserves the right to monitor and remove content at any time.
Any communication or material Customer transmits to Vamparossa by email or otherwise is treated as non-confidential and nonproprietary. Comments, feedback, suggestions, ideas, photographs, recipes, techniques, and similar submissions become the property of Vamparossa.
Customer assigns property rights for submissions to Vamparossa for unlimited use and grants Vamparossa a non-exclusive, sublicensable, irrevocable, transferable, royalty-free license under applicable intellectual property laws.
Vamparossa may contact Customer by postal mail, electronic mail, site notifications, instant message, or other means using provided contact information.
Vamparossa does not sell, trade, or transfer personally identifiable information to third parties and uses security measures to protect Customer information.
By using this Site or other Vamparossa media properties, Customer agrees to Vamparossa's use of data collection and analytics tools. This Site uses cookies to recognize Customer browsers, retain preferences, and compile aggregate traffic and usage data.
Customers may disable cookies in browser settings and may browse the Site anonymously. Vamparossa may use collected data for advertising purposes via third-party providers including Google and Facebook.
Vamparossa may provide links to outside third-party services. By using third-party pages, Customer assumes associated risks and is governed by those parties' terms and privacy policies. Vamparossa is not responsible for losses or damages resulting from dealings with third parties.
Vamparossa burners are shipped by ground service, usually UPS. Orders are generally fulfilled within 24 hours of receipt. If a burner is out of stock, lead time is typically not more than 3 weeks.
Any order canceled by Customer after shipment must be returned to Vamparossa's North Carolina facility at Customer's expense and inspected for damage before any refund is issued.
Customer is responsible for all product damage incurred during return shipping. Returned cancellations are subject to a 20% restocking fee on the purchase price when items are received without shipping or handling damage.
Vamparossa disclaims responsibility for damage caused by any shipping company not chosen, arranged, and paid for by Vamparossa, including shippers selected by Customer or Customer representatives.
If damage occurs through Customer-selected shipping, product warranty is void. Customer must file claims with their shipping company and/or insurance provider. Vamparossa may offer replacement parts or products at fair and reasonable cost at its sole discretion.
All prices on this Site are listed in U.S. Dollars (USD).
Use of Vamparossa products and reliance upon them is at Customer's sole risk. Except for the written Vamparossa warranty in the product operation and installation manual, Vamparossa disclaims all other express or implied warranties, including merchantability, quality, performance, fitness for a particular purpose, and non-infringement.
Some states do not allow limitations on implied warranties, so these limitations may not apply.
Vamparossa is not liable for consequential, incidental, statutory, punitive, exemplary, or indirect damages, including lost business, receiving/unloading/moving costs, or installation costs.
Customer must follow all product instructions and warnings in the installation and operation manual. If the manual is lost, Customer can request it from Vamparossa.
